OSHA Penalties Are Increasing Due to the Bipartisan Budget Act

The Bipartisan Budget Act of 2015 which was signed into law by President Obama on November 2, 2015 contained a Section 701, "Federal Civil Penalties Inflation Adjustment Act Improvements Act of 2015" which requires OSHA to increase its civil penalties for the first time since 1990. A one-time "Catch Up Adjustment" will occur in 2016 with penalties increasing up to a cap of 150%. The Federal Civil Penalties Inflation Adjustment Act of 1990 exempted OSHA from increasing its penalties to account for inflation, but this amendment removes that exemption. The maximum penalty for a willful violation would rise approximately 80%, to about $127,000 from the current $70,000. The changes must occur before August 1, 2016. And in subsequent years, with the exemption gone, OSHA also will be able to increase penalties levels based on inflation. See The National Law Review and Safety News Alert for more information.

    August 4, 2004 - Judge Shira Scheindlin of the U.S. District Court for the Southern District of New York, approved a Freedom of Information request originally made in October 2002 by the New York Times. The judge ordered the agency to release injury and illness rates for 13,000 work sites that had been notified by OSHA that they had exceptionally grievous records. If released, this list would effectively rank companies by the rate of accidents in their workplaces. The agency currently does not formally release injury and illness rates for specific work sites.
